Disclaimer of Liability for Package Shipments Sent to Fulfillment Centers
By sending packages to any global fulfillment centers or fulfillment warehouse/third party logistics company, the buyer acknowledges and agrees that LXY LLC, a Pennsylvania limited liability company, is released from any and all liabilities associated with the delivery, handling, and receipt of the merchandise. This includes, but is not limited to, loss, theft, or damage to the packages.
The buyer understands that LXY LLC is not responsible for any claims related to the full purchase price of any items shipped to these centers. The buyer assumes all risks associated with the shipment and acknowledges that, once the packages are in the custody of the fulfillment center, LXY LLC relinquishes all responsibility.
Additionally, the buyer agrees to be fully responsible for any legal fees incurred by LXY LLC as a result of issues arising from the shipment of packages. The buyer further acknowledges that any chargebacks initiated will be the sole responsibility of the buyer.
Furthermore, any litigation arising from this agreement shall take place in the state of Pennsylvania.
Disclosure Regarding Reporting Issues with Items
The buyer acknowledges and agrees that they have 24 hours from the time of receiving the package to report any items that are missing, defective, or not as described. By making the purchase, the buyer confirms their understanding of this timeframe and agrees to adhere to it.
Failure to report any such issues within the specified 24-hour period will be deemed acceptance of the item(s) as received in satisfactory condition, and the buyer forfeits any claims related to missing, defective, or misdescribed items thereafter.
The buyer also acknowledges that the return policy remains in full effect, and all returns must be made in accordance with the stated return policy guidelines.
